A Dallas County grand jury has indicted Wesley Mathews in the capital murder of his 3-year-old daughter.
Mathews initially told police that his daughter disappeared after he punished her by sending her out in the night to stand by a tree near their home.
Police say Mathews told investigators that Sherin Mathews choked on her milk. But after her body was found, he told police she choked to death and that he removed her body from the family's home in Richardson, about 15 miles (24 kilometers) north of Dallas.
The earlier charges were handed down in October and November 2017, while Mathew's murder charge was only today released after the Dallas County Medical Examiner ruled that the child's death was the result of homicidal violence, the Dallas Observer reported.
A statement from Sini Mathews' lawyers said that the indictments indicated that she had nothing to do with Sherin's death.
One for the capital murder of a person under 10 and the other for abandoning a child and tampering with evidence.
Police have said they believe Sini Mathews was sleeping when the girl went missing October 7.
Mathews' wife, Sini, was indicted for abandoning the child, which could get up to 20 years of jail time.
District Attorney Faith Johnson said evidence in the case was still unfolding Friday, but that there was no indication anyone else was involved in the death.
"Wesley Mathews...physically assisted the 3-year-old girl in drinking the milk", an arrest affidavit said.
Wesley Mathews was jailed on $1 million bond last fall.
He described a special diet regimen in which she had to eat whenever she was awake in order to gain weight.
An attorney for Wesley Mathews, Rafael de la Garza, did not immediately return a call for comment Firday.
Sini Mathews has maintained her innocence, KTVT has reported. The local police chief said it's been an intense case for his officers.
Mathews allegedly said he placed her body in the back of his auto with a bag of garbage, drove to a shopping center where he disposed of the garbage, then to a culvert where he hid her body, reports CBS DFW.
