Kashmir shut down against bids to abrogate Article 35 A

Senior advocate, G N Shaheen said, "When the matter is sub-judice, the comments of the executive authority are of no use".

The J&K Chief Minister, after the meeting, said, "Discussions on 35A have a negative impact on Jammu & Kashmir, it should not happen".

Transcending the ideological divide, Article 35A has brought the mainstream, separatists and all other sections of society together on a common cause. Most importantly, Article 14 refers to "persons" and not "citizens". Article 35A was not introduced in isolation.

Repealing Article 370 has been one of the core demands of the BJP and its ideological mentor, the RSS.

Protesters raised pro-freedom, pro-Pakistan and anti-India slogans and unfurled Pakistani flags at various places. "Constitution of India and Constitution of Jammu and Kashmir govern our living and existence but we have been vested with certain rights and we will protect those rights". In other words: the basic structure of the relationship between India and J&K is similar to that of other states. Therefore, Article 35A is in direct violation of Article 14. She claims that Mr Modi has fully assured her that his government will abide by the Agenda of Alliance and the special status of the state will not be tweaked in any way.

Following her meeting with Prime Minister Narendra Modi, Jammu & Kashmir Chief Minister Mehbooba Mufti said she received "100 percent assurance" on maintenance of the status quo of Articles 370 and 35A of the Constitution, which provide the state its "special status". Article 35A spawned a set of laws that were discriminatory in nature.

The article says that: "Saving of laws with respect to permanent residents and their rights". It allows the state legislature to define the "permanent residents" of the state, who would be entitled to own private properties in J&K.

The answer is a big no.

In occupied Kashmir, complete shutdown was observed, on Saturday, against the Indian plans to abrogate Article 35-A of its Constitution to convert Muslim majority of the territory into minority.

The Union government has rightly parted ways with the state government in front of the Supreme Court. There is an established procedure mentioned in the Constitution by which an amendment can be carried out.

It was envisioned as a "temporary provision" and that is how it should be treated.
